Rights and Legal Remedies of Data Subjects Under the Data Protection Act

As a data subject, you may request the following from Food Truck Show as the data controller:

a) Information regarding the processing of your personal data
b) Correction of your personal data
c) Deletion or blocking of your personal data, except for mandatory data processing

Upon request, the data controller provides information regarding the data it processes, including data sources, the purpose, legal basis, and duration of data processing, the name and address of the data processor, and any activities related to data processing. If personal data are transferred, the legal basis and recipient of such transfers will also be disclosed.

The data controller must provide the requested information in a clear and understandable format in writing within the shortest possible time, but no later than 30 days from the date of request.

The information is provided free of charge if the requester has not submitted a request for the same data within the current year. Otherwise, a cost reimbursement may be applied. If the data were processed unlawfully or the request led to a correction, any fee already paid must be refunded.

The data controller may only deny the request for information in legally defined cases and must provide written justification for such refusal, including the relevant legal reference. If the request is denied, the data controller informs the data subject about available legal remedies, including the possibility of taking the case to court or filing a complaint with the National Authority for Data Protection and Freedom of Information (NAIH).

Conditions for Data Deletion

Personal data must be deleted if:

a) The processing is unlawful
b) The data subject requests deletion
c) The data is incomplete or incorrect and cannot be lawfully corrected, provided that deletion is not prohibited by law
d) The purpose of data processing no longer exists, or the legally required retention period has expired
e) A court or authority orders the deletion

Instead of deletion, the data controller may block the data at the request of the data subject or if there is reasonable evidence that deletion would harm the data subject’s legitimate interests. Such blocked data may only be processed for as long as the purpose that prevented deletion remains valid.

Notification of Changes, Blocking, or Deletion

The data controller must notify the data subject and all parties to whom the data was previously transferred about any correction, blocking, marking, or deletion. Notification may be omitted if it does not violate the data subject’s legitimate interests.
If the data controller denies a request for correction, blocking, or deletion, it must provide written justification within 30 days of receiving the request. In such cases, the data controller informs the data subject about legal remedies, including taking the matter to court or contacting the National Authority for Data Protection and Freedom of Information (NAIH).

Right to Object to Data Processing

The data subject may object to the processing of their personal data if:
a) The processing or transfer of personal data is necessary solely for compliance with a legal obligation of the data controller or for the enforcement of legitimate interests of the data controller, data recipient, or a third party, except in cases of mandatory data processing
b) The personal data is used or transferred for direct marketing, public opinion research, or scientific research
c) Any other cases defined by law

The data controller must investigate the objection within the shortest possible time, but no later than 15 days, make a decision regarding its validity, and inform the applicant in writing.

If the objection is justified, the data controller must stop processing, including further data collection and transfer, and block the data. It must also notify all parties to whom the data was previously transferred, ensuring they take the necessary actions to enforce the right to object.

If the data subject disagrees with the decision or if the data controller fails to respond within the deadline, the data subject may take the case to court within 30 days. The court proceeding falls under the jurisdiction of the competent tribunal and may take place at the data subject’s place of residence or stay.

Anyone may file a complaint with the National Authority for Data Protection and Freedom of Information (NAIH) (1125 Budapest, Szilágyi Erzsébet fasor 22/C., www.naih.hu, ugyfelszolgalat@naih.hu) if they believe a violation of personal data rights has occurred or is at risk.
